Internet service and design agreement

Clients are defined as in agreement of the following statements, unless specifically requesting special considerations, which should be sent in writing, directly to ADYX2000.

Adyx 2000 reserves the right to suspend or terminate a client's account without notice or refund, levy additional charges or block access to relevant areas of the service, if the service has been misused. (refer to Acceptable Use Policy for definition of misuse)

In accepting this agreement the client agrees to indemnify Adyx 2000, against any claim, cost or liability incurred as a result of the clients use of the service.

Services must not be used for any illegal act or purpose. If a service is used for illegal purposes, Adyx 2000 may be required to terminate the service by relevant United Kingdom authorities. In these circumstances, clients will not be entitled to any refund or fees.

Clients must identify to Adyx 2000, any change of contact details. All contact details will remain confidential and Adyx 2000 will not supply this information to any third party, other than when requested by a recognized legal authority.

Liability for loss of service shall not exceed the proportionate amount of the subscription fee.

ADYX 2000 will not accept liability for any consequential losses.

Clients will not, under any circumstances, re-sell, rent out, or share use of the service, or any part thereof, to, or with any other person or company, except where specifically agreed by Adyx 2000, in writing.

Payments are normally due annually in advance.

English Law governs this agreement.

Adyx 2000 gives no warranty that access to servers shall be uninterrupted or error-free.

The client is responsible for backups of important files and information, although this is a default element of any account.

No person other than Adyx2000 managing director has the authority to modify or supplement these terms.

Accordingly this agreement may not be modified or supplemented without the express written consent of Adyx 2000's Managing Director.

Acceptable Use Policy
The Client must not use the Service:

to send, download, upload, use or re-use material that is abusive, indecent, defamatory, obscene or menacing, in breach of copyright or is in any other way unlawful or which contains viruses, worms, trojan horses or similar, or mass email marketing, or which may otherwise harm or damage the ADYX2000 network.

in connection with the carrying out of fraud or other criminal offence;

in a way that does not comply with the terms of any legislation; or
in a way, which does not comply with instructions given by ADYX2000
or its agents or contractors.

Disclaimer
The information listed in any designed website is given in good faith.

ADYX2000 shall not be responsible for any errors or omissions contained within any designed website, and reserves the right to make changes.

All ADYX2000 and third party information is provided on an "as is" basis.

ADYX2000 shall not be liable for indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to any of the information contained in any designed website, whether such damages arise in contract, negligence, under statute, tort, in equity, at law or otherwise.

ADYX2000 will in the respect of information listed in any designed website, inform the client as to edits made. It will be the responsibility of the client to ensure that all information displayed on the website is correct to their specifications, and in the event of an error, said error will be detailed and information provided to ADYX2000 to make the necessary amendments.

ADYX2000 does not offer a proof reading service of any information produced in any designed website.

ADYX2000 creates websites but does not directly host them. ADYX2000 shall not be responsible for any issues relating to the hosting of websites that it has created.
